Legislators write the law, NOT LAWYERS!

I know I am not supposed to gripe...but here I go anyway!

I do not make the law.

The legislature makes the law. Complaining to me about how the law is different in other states or getting upset at me because you do not like the law will not change anything! The law is not unfair and no one is picking on you; the law is applied exactly the same to you as it would be to anyone else under similar circumstances (OK, I recognize this is not always true; at times the law is unfairly applied due to race, sex, etc., but with my clients 99.99% of the time this is not the case). For the record, refusing to make a decision because you don't like the decisions available (aka throwing a fit because, "I have no good options!") will not change anything. If you want a law to be changed, write your legislators' or elect someone else to the position.

Further, judges do not make the law; judges merely interpret and apply the law. While they have more effect on changing a law than I do, they are bound by the law; they can not decide to apply the law in one case and not another. It does you no good to complain about the law at sentencing! It will only sound like whining which has never led to a reduced sentence...ever.

OK, that is my two cents for the day.
