Idaho Child Enticement
According to Idaho Code § 18-1509, a person may be guilty of Enticing a Child if that person attempts to
persuade, or persuades, through words or actions or both, a minor child, under the age of 16 to either
- Leave the child's home or school, or
- Enter a vehicle or building, or
- Enter a structure or enclosed area, or alley, with the intent that the child will be concealed from
public view
Additionally, this action must be done without the consent of the custodial parent, the state of Idaho, or
the legal custodian of the child.
However, if a person is attempting to provide aid or assistance to the minor child, then the detention is lawful.
Punishment for Child Enticement
The crime of Enticing a Child is a misdemeanor and punishable by a maximum of six months in jail
and/or a fine of no more than $1000.
If a person is convicted of Enticing a Child for a second or subsequent time, the crime is then a felony
and will be punished with a maximum of five years in prison.
