State v. DW
December 2018
Big Win In Boise County
Case Type: 1 Count of Felony Drug Trafficking, Two Counts Of Felony Possession Of A Controlled Substance, And One Count Of Misdemeanor Possession Of Drug Paraphernalia.
Jurisdiction: Boise County
Result: The Defendant plead guilty to 1 Count Of Felony Possession Of A Controlled Substance With The Intent To Distribute And One Count Of Felony Possession Of A Controlled Substance. The Court Ordered 5 Years Of Felony Probation.
This is a big win because the drug trafficking charges would have required the Defendant to spend at least 3 years in prison. Under the deal we negotiated with the prosecutors, the reduced charges allowed the prosecutors to request that the defendant be sentenced to prison but the judge was ultimately responsible for making the decision. In the end, the judge agreed with our assessment of the case and decided to sentence the Defendant to a term on felony probation rather than send him to prison.
