Big Win In Valley County!
This was a case involving a client who was investigated for the sale of large quantities of marijuana. After utilizing a confidential human informant ("CI") during the investigation the Valley County Prosecutor's Office charged this individual with 3 felony counts. After negotiations had concluded, I was able to convince the Prosecutor's Office to amend the charges to 2 counts of misdemeanor possession of marijuana.
Case Type: 3 Counts of Felony Distribution Of A Controlled Substance.
Jurisdiction: Valley County.
Result: The Defendant plead guilty to 2 counts of Misdemeanor Possession of a Controlled Substance.
The Defendant was sentenced to 4 years of supervised misdemeanor probation, 65 days in jail, fines, and drug/alcohol treatment and classes. Considering the Defendant was facing decades of prison time if convicted of the 3 felony charges, this is an extremely good result.
This resolution gives the Defendant the opportunity to prove himself. If he is charged with the any subsequent crimes, tests positive for any substance, or fails to abide by any of the other terms of probation, the Court has the ability to impose up to 7 years of jail time. Hopefully this is motivation to stay clean and avoid any future legal entanglements.
